Please read these Terms of Service ("Terms") carefully before using the VELARA application and website (the "Service") operated by VELARA ("us," "we," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

VELARA is an AI assistant platform providing access to multiple large language models, voice interaction, document analysis, legal research tools, creative tools, and other AI-powered features. The Service is available on iOS, Android, and web platforms.

3. Subscriptions and Billing

VELARA offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to the following:

• Subscriptions are billed on a monthly or annual basis as selected at checkout.
• Payments are processed securely by Stripe and, for mobile apps, through Apple App Store or Google Play.
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Refunds are subject to the refund policy of the platform through which you purchased (Apple, Google, or direct).
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

4. Founder's Circle Revenue Share Program

Founder's Circle members may participate in a revenue share program. By participating, you agree that:

• Revenue share percentages are determined by VELARA and may be updated with 30 days' notice.
• Payments are made monthly for qualifying referrals who maintain active subscriptions.
• Self-referrals and fraudulent referrals are prohibited and will result in termination of participation.
• Revenue share income may be subject to tax reporting obligations in your jurisdiction.

5. Acceptable Use

You agree not to use the Service to:

• Generate, distribute, or promote illegal content, including content that violates any applicable law.
• Harass, threaten, or harm other individuals.
• Attempt to circumvent subscription gates, usage limits, or security measures.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use the Service for automated bulk operations without prior written consent.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. AI-Generated Content

VELARA provides access to AI models that generate content based on your inputs. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, or inappropriate for certain purposes.
• VELARA does not guarantee the accuracy, reliability, or legality of AI-generated content.
• Legal, medical, financial, and other professional advice should be verified by qualified professionals.
• You are responsible for how you use AI-generated content.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by VELARA and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you input into the Service. You grant VELARA a limited license to process your inputs solely to provide the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. VELARA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us at hello@velaraai.app.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
